1. Preamble:

BsiGadget.com is a branch of Banking Support Italia S.r.l. and operates in the banking and economic operator sector as a "catalyst hub" for both purchases and sales. Its mission is to consolidate and share services and products, achieving economies of scale.

 

2. Contracting Parties:

This contract is between Banking Support Italia S.r.l., with registered office in Tradate -VA- Corso Bernacchi, 80 (hereinafter referred to as BSI), and the User, whose details are indicated in the individual "Customer" registration form.

Any person acting in the name or on behalf of the User will represent and bind him/her towards BSI.

 

3. Acceptance of the following general conditions:

All commercial relations between BSI and the User are exclusively regulated by the following general purchase/sale conditions, unless expressly derogated from by special conditions agreed upon in writing with BSI.

These general conditions, as well as any special conditions, are understood to be known and accepted by the User upon placing each individual order.

 

4. Terms and conditions of sale:

a. Reservation (purchase request)

By sending an order from the BSIGadget.com website, the User transmits a Reservation (purchase request) for the selected product or products. Sending the purchase order implies consent (pursuant to art. 11 Legislative Decree 196/2003) to receive the subsequent communications described below, which are solely for the purpose of concluding and executing the sales contract.

b. Confirmation of the Reservation (purchase request)

BSI, having verified the correctness of the Reservation (purchase request) and the availability of the goods, will send a confirmation for approval; complete with estimated delivery date and PDF file draft (if personalization with a logo or slogan is requested).

BSI makes the requested material available to the user for the following 48 hours, pending confirmation of the draft and payment.

c. Processing and delivery of the order

Once payment has been received, BSI will work on (personalize) or deliver to the carrier the ordered material.

The delivery time shown or agreed upon is always to be considered in working days, starting from the day on which any printing drafts are approved and payment is certified.

 

5 Prices:

All prices are exclusive of VAT.

BSI's price lists are those published on the BSIGadget.com website; however, they may be modified by BSI even without notice.

All personalized offers sent to the individual User are valid for 10 days from the date of the document.

BSI reserves the right to suspend orders in progress in the event of sudden price increases, resulting from serious external circumstances beyond BSI's control. In such cases, BSI will immediately inform the User and the order will remain suspended until a specific agreement is reached between the parties.

 

6 Password Responsibility:

The User undertakes to keep the alphanumeric codes (Password) necessary for using BSI's website in the strictest confidentiality and not to transfer them to third parties, and is therefore responsible for their safekeeping and correct use.

It is strictly forbidden for the User to transfer their Passwords to third parties, even temporarily and for any reason whatsoever.

 

7 Products:

For supply reasons, the products offered by BSI may come from different sources, therefore it is possible, from batch to batch, that there may be slight differences in color shades, sizes and finishes; however, these differences do not significantly alter the products themselves.

 

8 Warranty and refund:

The parties acknowledge that BSI is exclusively a dealer of products manufactured by third parties; therefore the warranty concerning the proper functioning of the products delivered by BSI is limited to that granted by the manufacturer and/or owner of the software. Where not expressly indicated, the manufacturer's and/or supplier's warranty is valid, according to the terms of law. Batteries and damage caused by improper use of the purchased goods are excluded from the warranty.

 

9 Return of goods and Refunds:

In the event that the products are not to the satisfaction of the customer, they may be returned for a refund or replacement (provided they are intact and not personalized) in writing within 14 (fourteen) days of receipt.

Returns must always be authorized in writing. Unauthorized returns will be automatically rejected.

The goods to be returned must be in perfect condition, in the original packaging and shipped free of charge to the warehouse indicated on the return authorization, accompanied by a regular transport document.

In the issuance of the credit note for the returned material, a deduction of 10% of the value of the returned goods will be applied, with a minimum of € 25.00, to cover general expenses of control and restocking.

In no case will returns of personalized or processed items be accepted.

Refunds will not be granted for amounts exceeding the value of the goods.

 

10 Tolerance:

In the case of items with advertising printing and typographic products, there may be a difference from the quantity ordered to the quantity actually delivered of ±10%.

In the event that the material delivered is less than the quantity ordered, we will issue a credit note corresponding to the value of the undelivered goods. If the amount to be refunded is less than € 10.00 + VAT, a discount voucher will be issued instead, equivalent to the value of the missing goods, to be used on a subsequent order, unless otherwise agreed.

 

11 Defects in supply:

The customer must report the existence of defects in supply within the forfeiture period of 8 (eight) days from the date of receipt of the goods, by registered letter addressed to Banking Support Italia S.r.l. Corso Bernacchi, 80 - 21049 TRADATE (VA) or by certified e-mail - PEC to the address certificata@pec.bankingsupport.it

After this period, the goods are considered accepted.

 

12 Right of withdrawal (valid only for private individuals and orders for non-personalized goods).

Pursuant to Legislative Decree 206 of 6 September 2005 (so-called CONSUMER CODE formerly Legislative Decree no. 185 of 22 May 1999), if the User is a consumer (i.e. a natural person who purchases the goods for purposes not related to his own professional activity, or does not make the purchase by indicating in the order form of BSigadget.com a VAT number reference), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. To exercise this right, the user must send BSI a communication to this effect, within 14 (fourteen) days from the date of receipt of the goods. This communication must be sent by registered letter with return receipt, addressed to Banking Support Italia S.r.l. Corso Bernacchi, 80 - 21049 Tradate (VA) or by certified e-mail to the address  certificata@pec.bankingsupport.it always sent within the aforementioned period of 14 (fourteen) days.

Once the above notice of withdrawal has been received, the BSI Customer Service will promptly communicate to the user the instructions on how to return the goods (with the exception of printed or embroidered goods). The goods must be returned intact and in the original packaging, complete with all their parts and without having suffered any damage whatsoever. Upon arrival in the warehouse, the goods will be examined.

Without prejudice to any restoration costs for ascertained damage to the goods, BSI will reimburse the user the entire amount already paid, within 14 (fourteen) working days from the date of receipt of the goods. It will be the User's responsibility to promptly provide BSI with the bank details (IBAN Code of the Current Account of the invoice holder), in order to obtain the refund of the price.

 

13 Orders

BSI accepts orders only and exclusively in writing, by e-mail (email) or via the internet from the website www.bsigadget.com (online).

Once the online booking procedure (purchase request) has been completed, the User will automatically receive a copy of the request with all the related data by e-mail (email). This does not constitute confirmation of the order by BSI, but rather a guarantee of what was requested through the website.

BSI reserves the right to verify the completeness and accuracy of the request. In the event of a negative outcome, the User will be informed immediately in order to reach a new agreement.

The order is considered effective from the day on which any print drafts are approved and payment is certified.

 

14 Payment

Payment is only possible by advance bank transfer or credit card through the service offered by PayPal.

Different forms of payment may be agreed upon from time to time by mutual agreement.

 

15 Delivery

In order to guarantee a better service, goods from the same warehouse will be shipped in a single delivery.

Delivery times are visible in the cart. Standard delivery may be 1/2 working days earlier or later than the indicated date.

All deliveries are intended to be curbside.

Different conditions, such as special requirements and/or penalties to be recognized to the User, are not allowed.

It is always possible, however, to reach specific agreements on delivery methods, to be agreed upon and evaluated from time to time.

EXPRESS PROCESSING

It is possible to request an early delivery date. The additional cost of express processing varies depending on the number of products and the number of days to be anticipated on the standard delivery date.

The express service takes precedence over all standard orders.In order to meet the delivery date, it is essential that:

  1. 5:00 p.m. of the same day, for requests made in the morning (up to 12:30 p.m.)
  2. 12:30 p.m. of the next working day, (excluding Saturdays, Sundays and holidays) for requests made in the afternoon (after 12:30 p.m.).

Any delays in the above points may cause a corresponding delay in the delivery date.

EXPRESS SERVICE GUARANTEE

BSI guarantees delivery to the express courier within 1 or 2 days prior to the requested delivery date.

In the event of non-delivery within the requested date, for reasons attributable to BSI, the entire amount of the express processing will be refunded.

Reimbursement will not be accepted for delays not attributable to BSI, for example:

Nothing else may be requested from BSI as reimbursement or compensation for damages.

 

16 Transport

Transport costs for delivery to the destination are borne by the customer.

The shipping cost, as a contribution to expenses, will be shown on the site in the cart management and will be charged as follows:

The delivery times of the ordered goods are purely indicative and are published in the appropriate table in the cart; they may be subject to variations due to force majeure or due to traffic conditions and road safety in general or by order of the Authorities.

Delays in delivery caused by the carrier, such as adverse traffic conditions, incomplete or incorrect address, impediments of various kinds, which do not allow the carrier to make the delivery within the standard times declared by the same, cannot be attributed to BSI, nothing can be claimed by the User as a refund or compensation for damages suffered.

 

17 Transportation Insurance

All shipments commissioned by BSI are covered by insurance.

It is therefore essential that:

Only in this case will the Insurance Company compensate for the damage or loss.

In the event that the carrier is instructed, for any reason, by the User (carriage paid), BSI cannot be held responsible for the loss and/or damage of the material, from the delivery of the goods to the carrier.

 

18 Transportation Liability

In case of unsuccessful transport due to theft, loss or damage of the material delivered by BSI and communicated by the User within the terms and conditions specified in point 17) Transport Insurance, BSI will:

Replace the missing or damaged material or issue a credit note.

Nothing else may be claimed by the User as compensation for damages suffered for reasons not directly dependent on BSI, such as late delivery, loss, total or partial damage of the material received or in receipt.

 

19 Personal Data Protection - (GDPR) in the EU

Please note that the User's data are stored and processed for the fulfillment of legal obligations and for the sending of our informative material and that such data are not subject to dissemination.

The User may request confirmation of the existence, updating, verification or cancellation of his/her data at any time.

20 Jurisdiction

The sale contract between the customer and BSI is understood to be concluded in Italy and governed by Italian Law.

For any dispute, the exclusive jurisdiction shall be that of the Court of Varese.

 

The contract is binding only in the original language; the English translation is for informational purposes only.
